This paper suggests, on the basis of a survey of law-making practices in Canada - including federal law and the legal systems of five Canadian provinces --, that ex ante impact assessment of enactments and statutory instruments, though initially advocated as a tool for preserving economic efficiency from a technical standpoint and within neo-liberal parameters, might come to assume a broader function towards legitimating public action in the eyes of a wide range of social actors. Considering such potential broadening of the purposes served ex ante impact assessment, as well as its increasing currency and sophistication, this law-making tool begs much closer attention on the part of the legal community.
